Safety officer loses appeal against jail after worker falls through lift shaft

A safety officer for a contracting firm has lost an appeal against a two-month prison sentence for negligence after a worker tumbled 21 floors through an open lift shaft.

The Federal Supreme Court in Abu Dhabi upheld an earlier ruling by an Ajman court that found the Arab employee guilty of causing the death of an Asian worker through negligence.

The safety officer was also ordered to pay blood money of Dhs200,000 to the victim’s family. Official documents show the victim was employed on a newly-constructed Ajman building when he fell down the lift shaft on the 21st floor and plunged to the ground. Prosecutors said the safety officer neglected his duties of ensuring safety on the site.

“The man had left the shaft open with no barrier to stop unsuspecting workmen from plunging to the ground,” the court was told. Officers added that as well as failing to place warning signs to alert workers to the presence of the shaft, the safety officer also failed to ensure that the worker wore the correct gear, including safety shoes, helmet and gloves.

However, the defendant insisted the worker had fallen down the shaft during afternoon rest time and that it was not compulsory for workers to wear safety clothes on a break
